Say it exactly — or don't say it

California's Commercial Coventurer rules require specific, verifiable language before any 'proceeds to charity' claim. This is the LiveSwell template. Counsel must review before external use.

What CCV requires

Five things every campaign must disclose

  1. 1. The exact dollar amount or percentage per unit donated (e.g. "$0.25 per can" — not "a portion of proceeds").
  2. 2. The full legal name of the recipient nonprofit and its 501(c)(3) status.
  3. 3. The start and end dates of the campaign.
  4. 4. The maximum aggregate donation (cap), if any.
  5. 5. Registration with the California Attorney General's Registry of Charitable Trusts (Form CT-5CF) before the campaign begins, and reporting (Form CT-6CF) after.

Short-form is only permitted when the long-form disclosure is one click / one QR-scan away.

Do not say

Language that triggers CCV non-compliance

  • ❌ "A portion of proceeds benefits [cause]."
  • ❌ "Support [nonprofit] with every sip."
  • ❌ "Buy a can, plant a tree." (unless the ratio, cap, and dates are stated)
  • ❌ Anything implying tax-deductibility to the purchaser.

Filing checklist

Before launch

CT-5CF filed · written agreement with nonprofit executed · disclosure language reviewed by counsel · point-of-sale materials proofed against template.

After campaign

CT-6CF filed within 90 days · donation transferred within timeframe stated in agreement · records retained 10 years.
